ECI has received petition seeking disqualification of MLAs: JAC

Joint Action Committee, which is seeking the disqualification of 14 MLAs, has said that the Election Commission of India has received the petition which was forwarded by the Governor of Sikkim and is considering the case.
Addressing a press conference here today, JAC chief coordinator, Nawin Kiran Pradhan, informed that they have received a letter from the Election Commission of India mentioning that the petition sent by the Governor was received by the commission.
He further informed that the ECI had also sent a letter for the Chief Secretary of Sikkim on 14 Mar 2018 to inquire whether the 14 MLAs have been saved by an Act of the legislature.
“We enquired with the Chief Secretary office about the letter on 27 Mar and the CS office confirmed that the letter has been received and they are working on it,” he said.
Mr Pradhan has again sent a memorandum to the ECI along with a copy of the judgment in Pahalman Subba and others Vs State of Sikkim and others of the High Court of Sikkim dated 25 Aug, 2017. He stated that in this case, these 14 MLAs have not only held the office of profit but also enjoyed various benefits. He further added that posts of Parliamentary Secretaries have already been declared unconstitutional so these MLAs should be disqualified.
The committee has sought the disqualification of the MLAs for holding office of profit.
