JAC visit ECI on MLA disqualification appeal
Gangtok, 17 Jul:
A team of representatives of Joint Action Committee [JAC] today visited the Election Commission of India in New Delhi to place a submission before the Commission with regard to the disqualification of MLABikramPradhanon office of profit grounds, a JAC press release informs.
It may be recalled here, after the High Court of Sikkim’s judgment on the Parliamentary Secretary case, MrPradhan was also removed as Government Chief Whip on 28 Aug 2017.
“After that we had filed a disqualification petition against 14 MLAs before GovernorShriniwasPatil. The Governor had forwarded the petition to the ECI for an opinion.Out of 14 MLAs, it was confirmed to us by the Commission that MrPradhan’s matter is still pending before the Commission and it was very recently that he had filed a reply to the Commission. In this matter, we requested the Commission to give us an opportunity to file a rejoinder to the reply under the doctrine of Audi AlteramPartem,” the JAC informs in the release.
It is further informed that the JAC team has also met different officials of the ECI and has submitted various petitionsrelated to election matters.
“We also met some Constitutional experts and discussed the case of 13 MLAs to file a Judicial Review Writ against the Order of the Governor regarding the 13 MLAs. However, at present we have decided to presently focus on MrPradhan’s case and the case of other 07 MLAs is pending before the Speaker under the Anti Defection Law,” the release adds.
