Bar Association issues legal notice to SKM worker for Facebook post Threatens to seek Rs 1 cr in damages

Gangtok, 04 Dec:
The Bar Association of Sikkim has issued a legal notice to a Sikkim KrantikariMorcha worker,ChetanBhattarai, for his derogatory remarks againstthe legal fraternity on a Facebook post made on 02 Dec.

MrBhattarai is accused of posting, “Unnecessary liabilities created by RB Subba during SDF tenure has been dismissed,” referring to the issuance of Discharge Notice No: 21(634) L7PAL/2019/405 dated 02 Dec, 2019.

It may be mentioned that the state government had issued discharge notice to 29 Public Prosecutors on 02 Dec.

“It is disheartening to note that despite putting in many years of hard work and dedicated service as Government Advocates and Public Prosecutors, your derogatory and defamatory allegation of them being “Unnecessary Liability” is uncalled for and offensive,” the legal notice issued byBAS general secretary, TR Barfungpa states.
Addressing the media here at Gangtok, MrBarfungpa said that the Bar Association of Sikkim has also considered the service rendered by the concerned members who were assigned to various posts in the courts and tribunals. He also added that use of the word ‘fired’ for the lawyers who were given discharge notice is not appropriate.

BAS has demanded that ChetanBhattarai tender unconditional apology to the Bar members listed in the discharge notice and also to the Bar Association of Sikkim.

The association has further demanded that the said unconditional apology be published in all print and social media with a copy to the Bar Association of Sikkim within 48 hours from the receipt of the notice failing which the Bar Association of Sikkim will initiate legal proceedings against him claiming as damages Rs.1 crore for damaging the reputation and image of the members of the Bar Association of Sikkim.Bas further said that he shall also be liable for criminal offence.
